{"id":7087,"date":"2026-06-24T16:03:07","date_gmt":"2026-06-24T16:03:07","guid":{"rendered":"https:\/\/andime.cl\/?p=7087"},"modified":"2026-06-24T16:03:07","modified_gmt":"2026-06-24T16:03:07","slug":"andime-y-resolucion-del-tc-por-escuela-protegida-advertimos-que-este-proyecto-vulneraba-derechos-y-se-nos-dio-la-razon","status":"publish","type":"post","link":"https:\/\/andime.cl\/index.php\/2026\/06\/24\/andime-y-resolucion-del-tc-por-escuela-protegida-advertimos-que-este-proyecto-vulneraba-derechos-y-se-nos-dio-la-razon\/","title":{"rendered":"ANDIME y resoluci\u00f3n del TC por Escuela Protegida: \u201cAdvertimos que este proyecto vulneraba derechos y se nos dio la raz\u00f3n\u201d"},"content":{"rendered":"<p><i><span style=\"font-weight: 400;\">En abril pasado <\/span><\/i><span style=\"font-weight: 400;\">la Asociaci\u00f3n Nacional de Trabajadoras y Trabajadores del Ministerio de Educaci\u00f3n (ANDIME)<\/span><i><span style=\"font-weight: 400;\"> advirti\u00f3 al Senado sobre los riesgos de revisar mochilas, permitir intervenciones policiales sin control del Ministerio P\u00fablico y establecer sanciones que podr\u00edan afectar derechos fundamentales.<\/span><\/i><\/p>\n<p><i><span style=\"font-weight: 400;\">\u00a0Andime <\/span><\/i><span style=\"font-weight: 400;\">afirm\u00f3 que el reciente fallo del Tribunal Constitucional sobre el proyecto de ley \u201cEscuelas Protegidas\u201d confirma las advertencias que la organizaci\u00f3n formul\u00f3 durante la discusi\u00f3n legislativa de la iniciativa.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">En una presentaci\u00f3n enviada a la Comisi\u00f3n de Educaci\u00f3n del Senado el 22 de abril de este a\u00f1o, ANDIME sostuvo que el proyecto abordaba un problema real, como es el aumento de los hechos de violencia en establecimientos educacionales, pero lo hac\u00eda desde una l\u00f3gica excesivamente punitiva, trasladando al espacio escolar herramientas propias del \u00e1mbito policial y penal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El Tribunal Constitucional termin\u00f3 objetando precisamente algunos de los aspectos cuestionados por la organizaci\u00f3n, entre ellos las normas sobre revisi\u00f3n de mochilas y efectos personales, la intervenci\u00f3n de Carabineros o la PDI sin autorizaci\u00f3n previa del Ministerio P\u00fablico, las sanciones por interrupci\u00f3n de clases y las restricciones al acceso a la gratuidad en educaci\u00f3n superior.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La presidenta nacional de ANDIME, Mar\u00eda Beatriz Fuenzalida, se\u00f1al\u00f3 que \u201cvaloramos que el Tribunal Constitucional haya puesto l\u00edmites a disposiciones que pod\u00edan afectar derechos fundamentales y generar una mayor judicializaci\u00f3n de los conflictos escolares. Lo que planteamos oportunamente fue que la convivencia escolar no puede resolverse \u00fanicamente desde la l\u00f3gica del castigo\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La dirigenta agreg\u00f3 que \u201cadvertimos que se estaba cargando sobre directivos, docentes y asistentes de la educaci\u00f3n responsabilidades para las cuales no exist\u00edan protocolos claros ni respaldo institucional suficiente. Hoy queda demostrado que esas preocupaciones ten\u00edan fundamento\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Desde ANDIME insistieron en que la violencia escolar requiere una respuesta integral que incorpore prevenci\u00f3n, fortalecimiento de equipos multiprofesionales, apoyo a la salud mental y mejores condiciones para las comunidades educativas.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cLas escuelas necesitan m\u00e1s herramientas para prevenir y abordar los conflictos, no transformarse en espacios de vigilancia permanente. Combatir la violencia es una tarea urgente, pero debe hacerse fortaleciendo la educaci\u00f3n y no debilitando las garant\u00edas que protegen a estudiantes y trabajadores\u201d, afirm\u00f3 Fuenzalida.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Finalmente, la organizaci\u00f3n llam\u00f3 al Ejecutivo y al Congreso a retomar el debate legislativo considerando la experiencia de quienes trabajan diariamente en el sistema educativo y a construir una pol\u00edtica que combine protecci\u00f3n, convivencia y derechos.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cEste fallo debe servir para corregir el rumbo. La seguridad en las escuelas es una necesidad compartida, pero las soluciones deben ser eficaces, proporcionales y compatibles con el car\u00e1cter formativo que debe tener toda comunidad
