{"id":6899,"date":"2025-10-25T16:22:49","date_gmt":"2025-10-25T16:22:49","guid":{"rendered":"https:\/\/andime.cl\/?p=6899"},"modified":"2025-10-28T16:29:08","modified_gmt":"2025-10-28T16:29:08","slug":"andime-en-alerta-fallo-de-la-corte-suprema-sobre-confianza-legitima-debilita-el-estado-y-vulnera-derechos-laborales","status":"publish","type":"post","link":"https:\/\/andime.cl\/index.php\/2025\/10\/25\/andime-en-alerta-fallo-de-la-corte-suprema-sobre-confianza-legitima-debilita-el-estado-y-vulnera-derechos-laborales\/","title":{"rendered":"ANDIME en alerta: fallo de la Corte Suprema sobre \u201cconfianza leg\u00edtima\u201d debilita el Estado y vulnera derechos laborales"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">La Asociaci\u00f3n Nacional de Funcionarios del Ministerio de Educaci\u00f3n (ANDIME) expresa su profunda preocupaci\u00f3n ante el reciente fallo de la Corte Suprema en materia de confianza leg\u00edtima, que representa un grave retroceso en la protecci\u00f3n de los derechos laborales de las y los trabajadores del sector p\u00fablico y en las garant\u00edas que debe ofrecer el Estado a la ciudadan\u00eda.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este fallo, al relativizar la estabilidad de los v\u00ednculos laborales en el empleo p\u00fablico, abre un escenario de mayor precarizaci\u00f3n y debilitamiento institucional, atentando contra los principios de continuidad, m\u00e9rito y probidad que sustentan la funci\u00f3n p\u00fablica.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Desde ANDIME consideramos inaceptable que el propio Estado mantenga estructuras contractuales fragmentadas que reproducen la desigualdad: apenas un 22,1 % del personal en planta, frente a un 55,6 % a contrata, un 5,6 % a honorarios y un 16,7 % en condiciones laborales inestables. Esta realidad contradice los compromisos internacionales asumidos por Chile en materia de trabajo decente y empleo digno.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cLa estabilidad laboral es una condici\u00f3n b\u00e1sica para garantizar un Estado al servicio de las personas. No puede haber modernizaci\u00f3n ni fortalecimiento institucional si persisten formas de contrataci\u00f3n que precarizan la labor p\u00fablica y vulneran derechos fundamentales\u201d, se\u00f1al\u00f3 la Directiva Nacional de ANDIME.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La Asociaci\u00f3n hace un llamado al Gobierno y al Parlamento a impulsar de manera urgente una reforma estructural al sistema de empleo p\u00fablico, que ponga fin a la precarizaci\u00f3n, garantice continuidad y estabilidad a quienes cumplen funciones permanentes, y restituya el principio de confianza leg\u00edtima entre el Estado y sus trabajadores.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ANDIME reitera su compromiso con la defensa del empleo p\u00fablico, la dignidad laboral
